Your rights online
When you are buying online with an Australian trader you have the exact same rights that you would if you were buying in an actual shop.
There are no specific laws in Australia relating to online shopping. However if you are buying over the internet from an Australian trader, Australian consumer protection laws apply.
Buying from a private seller
This is where you buy from a person who is not running an online business. Examples include buying a bike off Gumtree or buying a dress on eBay.
If you buy something from a private seller you are guaranteed clear title of the item, unless you were told otherwise before the sale. This means that the seller guarantees that there is no money owing on the item and nobody else is entitled to repossess or take back the item.
If you are making a big online purchase, such as buying a car or a boat you should ensure it has clear title. A lawyer can help you check on the Personal Property Securities Register (PPSR) if this is so.
Drip pricing
Drip pricing is where a price is advertised for a good but more fees and charges keep on being added on, which results in paying a higher price than what was advertised to you.
Businesses aren't allowed to mislead you into paying those fees without telling you upfront how much it will cost. You must be told about all additional fees and charges at the beginning of the purchase.
If you were charged additional fees that you weren't told about at the beginning of the online purchasing process you can lodge a complaint with the Australian Competition and Consumer Commission (ACCC).
International purchases
If you buy from an international trader, Australian Consumer Law still applies. However they still have to comply with the consumer laws in the country that they are based in.
For example if you are buying from www.amazon.com they are required to comply with American Consumer Law.
All buyers are subject to certain rights. If you feel you are a victim or have been misled, engage a lawyer to help you return your item or get your money back.
