What is spam?
Spam refers to unwanted commercial electronic messaging. ‘Electronic messaging’ covers emails, instant messaging, SMS and other mobile phone messaging, but does not cover normal voice-to-voice communication by phone. Something is considered spam if:
- The message is commercial (i.e. it is trying to sell you something or direct you to a location to buy something) and
- You didn’t consent to those messages.
How to send legally
If you have a business, and want to send a message to someone else promoting your business, you must take several precautions to ensure your messages aren’t considered spam:
- Get their consent – Send your commercial messages only to people who have consented to receive that message. The receiver could have expressly given their consent (i.e. Said yes) or you could’ve had a history of dealing with this person and have always sent them messages which they accept.
- State your identity – Your commercial messages should always contain clear and accurate identification of the person responsible for the message, and how they can be contacted.
- Unsubscribe Option – Your commercial messages must contain an unsubscribe facility, allowing people to indicate that such messages should not be sent to them in the future.
