Section 42 Fines, Penalties and Infringement Notices Enforcement Act 1994 (WA) – Notice of intention to enforce
When you receive a fine, the Registrar may seek to issue a notice of intention to enforce should you fail to pay the fine. The notice must be served upon you to take effect. The notice essentially states that unless the amount owed is paid (by the due date) the Registrar may make a licence suspension order, issue a warrant for arrest, issue an order to attend for work and development and/or in some circumstances, may issue a warrant of commitment.
Section 43 Fines, Penalties and Infringement Notices Enforcement Act 1994 (WA) – Licence suspension order
If 28 days have elapsed since the date of issue of a notice of intention to enforce and the amount owed has not been paid then the Registrar may make a licence suspension order in respect of the offender.
If the offender is an individual a licence suspension order may disqualify the offender from holding or obtaining a driver’s licence, holding or obtaining a vehicle licence in respect to the vehicles specified in the order, or in respect to any vehicle.
If the offender is a body corporate a licence suspension order may disqualify the offender from holding or obtaining a vehicle licence in respect to vehicle specified in the order, or in respect to any vehicle.

What if I cannot afford to pay?
If you cannot afford to pay your fines, there are two things you can do:
How much community service will I be ordered to do?
You will have to do 6 hours of community service for every $300 that you have not paid.
Over what period can I do the community service?
You will be able to choose how many hours you would like to do community service for over a period of time. However, you have to perform at least 12 hours a week.
What happens if I do not comply with the community service order?
If you do not comply with the community service order, you may face imprisonment.
What if I earn enough money to pay off the remainder of the fine?
If during the community service, you have enough money to pay the remainder of the fine in full, you will inform the Community Justice Service Office you are attending. They will issue you with a ‘pay-out’ letter stating the outstanding monies owed. You will then have to pay all the monies in full.
Can a traffic lawyer help me get my licence back after suspension?
Yes, you have several options available to you:

Will I lose my licence?
The Fines Enforcement Registry may make a licence suspension order for non-payment of fines. In this case, the licence suspension will remain in force until the fine and enforcement fees have been paid or this amount has been recovered under an enforcement warrant.
Ideally, you should seek help from a lawyer so he/she can advise you as to whether you might be able to have the licence suspension set aside.
Will i go to prison?
Failure to pay your fines within the stipulated time may result in the Registrar issuing you with a warrant of commitment. This means that you will be arrested and sent to prison for a period of time calculated according to the amount of the fine.
Generally, imprisonment is a last resort and the Registrar will usually consider a work and development order instead. Once again, it is best to seek help from a lawyer so he/she can advise you of the possibility of imprisonment.
